Statement of the indigenous People of West Papua (PNWP)

STATEMENT OF THE INDIGENOUS PEOPLE OF WEST PAPUA
WEST PAPUA NATIONAL PARLIAMENT (PNWP)

Recalling the Agreement between the Republic of Indonesia and the Kingdom of the Netherlands concerning West New Guinea (West Papua), signed and ratified at the United Nations Headquarters in New York, USA, on 15 august 1962 and recorded under Resolution 1752 (XVII) of the United Nations, dated 21 september 1962.
Recalling the Articles of Association of the National Parliament of West Papua regarding the Seats, the Duties and the powers of Parliament.
Noting the demand of the People of West Papua for recognition of it’s ”right to self-determination”, an absolute right of the Nation and of the indigenous People of West Papua.

Recalling also the duties and the powers of the Parliament, and, accordingly, the Members of the National Parliament of West Papua have come together and met in Waena, Hollandia (Jayapura), Papua province from 1st until the 4th of the month of April 2016, to talk about to the rights of the Papuan People and the territory of West Papua, during the fourth annual session of the National Parliament of West Papua.

THE ASSEMBLY OF THE NATIONAL PARLIAMENT OF WEST PAPUA:

Having received and recorded reports of the indigenous population of West Papua who reside in the territory of West Papua and who resides outside outside the territory of West Papua, to the effect that:
The Indonesian Republic has not respected the rights of the indigenous People of West Papua in the context of the exercise of the right to self-determination, as stipulated in the Agreement between the Republic of Indonesia and the Kingdom of the Netherlands concerning Dutch New Guinea (West Papua), signed and ratified at the United Nations Headquarters in New York, USA, on 15 august 1962 and recorded under the resolution 1752 (XVII) of the United Nations, dated 21 september 1962.

The Indonesian Armed Forces (ABRI), under the self-serving legitimacy of the People’s Threefold Command (Tri Komando Rakyat) of 19 December 1961, conducted military operations to arrest, torture, rape women and kill, as well as to rob the indigenous People of West Papua from their economics rights. These acts began right after the United Nations Executive Temporary Authority (UNTEA) handed over the administration of the territory of West New Guinea (West Papua) to the republic of Indonesia on 1 may 1963.

The Republic of Indonesia has precluded all adults, men and women, non-foreigners, who were residing on the territory of West Papua at the time of the signing of the Agreement, and at the time of the crystallization of the right to self-determination, by unilaterally appointing 1026 people and by making them attend, under weapons threat from the Indonesian military, the consultative meeting on Indonesia’s Five-Year Development Plan (REPELITA), a meeting which was later described in the implementation report to the Secretary General of the United Nations in the UN General Assembly in November 1969, using the terms the ”Act of Free Choice” of 1969 (PEPERA 1969).
THE ASSEMBLY OF THE NATIONAL PARLIAMENT OF WEST PAPUA

Having noted the deep resentment and concern of the people of West Papua upon learning of the receipt of the Report of the Indonesian Republic at the Sessions of the United Nations General Assembly on 19 November 1969, a consultation erroneously called the ”Act of Free Choice” (PEPERA), which was contrary to the will and the conscience of the people of West Papua.

Having noted the reports of the People of West Papua regarding the organizing of the Papuan People in West Papua to take steps towards the prosecution of the Indonesian Republic’s violations of the international law and human rights, in relation to the implementation of the right to self-determination of the Papuan people of West Papua.

Having noted the demands of the Papuan People, to the Republic of Indonesia and other countries, to respect Human Rights which are intrinsically linked to the Papuan People’s right to self-determination.

Having noted [former] Indonesian President Abdurrahman Wahid’s recognition of the right to self-determination of the Papuan People in West Papua and the necessity for the rights of the citizens to be guaranteed.

Having noted reports from residents of West Papua, submitted through Members of the National Parliament of West Papua, on the security situation, a situation which is gradually eliminating all guarantees for the respect of Human Rights of the indigenous People of West Papua, since abdurrahman Wahid was removed as President of the Republic of Indonesia by the People’s Concultative Assembly of the Republic of Indonesia (MPR RI) in 2001.

THE ASSEMBLY OF THE NATIONAL PARLIAMENT OF WEST PAPUA
Having noted with appreciation the awareness the awareness and moral support of the international community for the respect of the right self-determination of the Papuan People of West Papua.
Having noted with appreciation the joint communique of the Melanesian Spearhead Group (MSG) in Noumea dated 20 June 2013 which ”fully supports the inalienable rights of the People of West Papua towards self-determination”.
Having noted with appreciation the concern of States over reports of Human Rights violations that continue to occur in West Papua (i.e., what is known in the Indonesian colonial administration as the provinces of Papua and West Papua).
Having noted with appreciation the Joint Comminque of tthe Pacifc Islands Forum (PIF) in Port Moresby Papua New  Guinea, dated 11 September 2015, which noted concerns about the Human Rights situation, calling all parties to protect and uphold the Human Rioghts of all residents  in Papua (i,e,, what is known in the Indonesian colonial administration as the provinces of Papua and West Papua) and to work to address the root causes of such conflicts by peaceful means.

THE ASSEMBLY OF THE NATIONAL PARLIAMENT OF WEST PAPUA

Having considered all of the above, subsequently all the participants of the Assembly of the West Papua National Parliament unanimously:

Decided as follows:

States that the Republic of Indonesia has failed to implement the 1969 Act of Free Choice for the residents of West Papua and his has led to a conflict that has claimed many victims of Human Rights violations in West Papua.
Declares that the security developments in West Papua are becoming increasingly disurbing to the indigenous People of West Papua with a growing number of Indonesian military personnel being brought in from outside the region of West Papua by the Indonesian National Army.
Acknowledges with respect the joint communique of the Leaders of the Pacific Islands Forum (PIF) to form a fact-finding team to come and hear directly from indigenous Papuans the testimonies related to violations of Human Rights in West Papua.
Recommends to the International Parliament for West Papua (IPWP) than unifying call be made to the international community by which Member States are requested to urge the United Nations to implement a Referendum as soon as possible for the Papuan People in West Papua, at the earliest opportunity, and by which Interntion Security Forces are assigned with the task of ensuring the security and a sense of safety for the residents of West Papua, in the framework of the implementation of their right to self-determination.
Acknowledges with appreciation the United Liberation Movement for West Papua (ULMWP) as the body that represents the interests of the Papuan people of West Papua (i.e, what is known in the Indonesian colonial administration as the provinces of Papua and West Papua) at sub-regional, regional and international fora.

SHALL RECEIVE AND IMPLEMENT THE DECISIONS OF THE PAPUAN PEOPLE WHICH WERE TAKEN DURING THE FOURTH ANNUAL SESSION OF THE NATIONAL PARLIAMENT OF WEST PAPUA ON 4 APRIL 2016, AS STIPULATED IN THE STATEMENT OF THE INDIGENOUS PEOPLE OF WEST PAPUA.
